Content & Purpose 

This privacy policy (“Privacy Policy”) applies to your use of the domain name SPLENDID.APP, an internet-based portal, and our mobile application, owned/operated by Splendid App Private Limited, a company duly incorporated under the provisions of the Indian Companies Act (hereinafter, referred to as “Splendid” or “We” or “Our” or “Us” or “Company”). The domain name and the mobile application are collectively referred to as “Website”. 

  1. The Website is a digital platform that inter-alia enables the enterprises or creators or merchants to connect to its customers by way of integration of social media platforms, app ordering & billing systems, and bank/payment gateways (hereinafter referred to as “Services”). The Services would be made available to such persons who have agreed to become buyers on the Website after obtaining due registration/accepting necessary terms and conditions, following the procedure as determined by us, from time to time (referred to as “You” or “Your” or “Yourself” or “User”, which terms shall also include persons who are accessing the Website merely as visitors). 
  1. We have implemented reasonable security practices and procedures that are commensurate with the information assets being protected and with the nature of our business. While we try our best to provide security that is commensurate with the industry standards, because of the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to us by you. 
  1. To provide the Services and for other purposes identified in this Privacy Policy, we will be required to collect and host certain data and information of the Users. We are committed to protecting the Personal Information (as defined below) of the Users and take all reasonable precautions for maintaining the confidentiality of the User’s Personal Information. This Privacy Policy has been designed and developed to help you understand the following: 

The type of Personal Information (including Sensitive Personal Data or Information) that we collect from the Users; 

  • The purpose of collection, means, and modes of usage of such Personal Information by the Company; 
  • How and to whom the Company will disclose such information; 
  • How the Company will protect the Personal Information including Sensitive Personal Data or Information that is collected from the Users; and 
  • How Users may access and/or modify their Personal Information. 

 

This Privacy Policy shall apply to the use of the Website by all Users. Accordingly, a condition of each User’s use of and access to the Website and the other services provided by the Company to Users is their acceptance of this Privacy policy. Any User is required to read and understand the provisions set out herein before submitting any Sensitive Personal Data or Information to the Company, failing which they are required to leave the Website immediately. 

This Privacy Policy is published in compliance with the (Indian) Information Technology Act, 2000, and the rules, regulations, guidelines, and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.  

Subscribers Fans or Customers 

A subscriber fan or customer is someone who joins the Splendid platform to support a creator’s content or business. You may have to make a payment on our platform to avail the benefits or purchase any services offered by a creator. We assure you that the payments get processed by the most trusted third-party payment gateways. 

We collect and process information about the creators you support, the level at which you support them, what benefits you receive, and how often you support them. As a subscriber, if you select a benefit with a physical benefit, then you have to provide your shipping information so the creator can ship you the benefit. 

Creators, Merchants or Artists 

A creator is someone who creates and provides content or services for their subscribers or customers through the Splendid platform. To become a creator, you must create a page (also called a creator’s website) that describes what you are creating and any benefits you are offering. To receive pay-outs, you have to provide us your preferred payment mode with your details e.g., UPI / Bank Transfer, etc. You must also provide us with additional information for tax purposes. 

  • Legal name 
  • Address Proof 
  • PAN Card / Aadhar Card 
  • GST (if required) 
  • FSSAI (if required) 

 

Personal Information 

“Personal Information” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available with the Company, is capable of identifying the person concerned. 

“Sensitive Personal Data or Information” means Personal Information of any individual relating to password; financial information such as bank account or credit card or debit card or other payment instrument details; physical, physiological, and mental health condition; sexual orientation; medical records and history; biometric information; any detail relating to the above as provided to or received by the Company for processing or storage. However, any data/information relating to an individual that is freely available or accessible in the public domain or furnished under the Right to Information Act, 2005, or any other law shall not qualify as Sensitive Personal Data or Information. 

 

 

 

 

Types Of Personal Information Collected by The Company 

A User may have limited access to the Website and utilize some of the Services provided by the Company without creating an account on the Website. Unregistered Users can access some of the information and details available on the Website. To have access to all the features and benefits on our Website, a User may be required to first create an account on our website. As part of the registration process, we may collect the following categories of Personal Information from the Users (hereinafter collectively referred to as “User Information”): 

  • Name 
  • User ID 
  • Email address 
  • Address (including country and ZIP/postal code) 
  • Gender 
  • Age 
  • Phone Number; 
  • Password chosen by the User 
  • Valid financial account information; and 
  • Other details as the User may volunteer 

To avail of the Services, the Users may be required to upload/share certain documents, on the Website and/or e-mail the same to the Company by the Website’s terms of use (“Terms & Conditions”) and such documents will be stored/disclosed by the Company only in the manner specified in this Privacy Policy and the Terms of Use. The term “User Information” shall also include any such documents uploaded or otherwise provided by Users. We may keep records of telephone calls received and made for making inquiries, orders, or other purposes for administration of Services. 

Independent Contractors 

The Company and the Merchant or creator are each independent contractors and this Agreement shall not be construed to create an association, partnership, joint venture, relation of principal and agent, or employer and employee between the Parties or its agents within the meaning of any applicable law. Neither party will enter into any agreement, oral or written, on behalf of the other or otherwise obligate the other party without that party’s advance written approval.  

 

Code Of Conduct  

Merchant or creator shall refrain from using the services given by the company to promote unlawful, illegal activities, unwanted marketing, email spamming, abusive language, and sexual content (express or implied).  

Cookies 

To improve the responsiveness of the sites for our users, we may use “cookies”, or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the user’s interests using the Identified Computer. Unless you voluntarily identify yourself (through registration, for example), we will have no way of knowing who you are, even if we assign a cookie to your computer. The only personal information a cookie can contain is information you supply (an example of this is when you ask for our Personalised Horoscope). A cookie cannot read data off your hard drive. Our advertisers may also assign their cookies to your browser (if you click on their ads), a process that we do not control.  

Our web servers automatically collect limited information about your computer’s connection to the Internet, including your IP address, when you visit our site. (Your IP address is a number that lets computers attached to the Internet know where to send you data — such as the web pages you view.) Your IP address does not identify you personally. We use this information to deliver our web pages to you upon request, to tailor our site to the interests of our users, to measure traffic within our site, and to let advertisers know the geographic locations from where our visitors come. 

Internet Use 

We may also receive and/or hold information about the User’s browsing history including the URL of the site that the User visited before visiting the website as well as the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using as well as the name of User’s ISP. The Website uses temporary cookies to store certain data (that is not Sensitive Personal Data or Information) that is used by us for the technical administration of the Website, research and development, and User administration. 

  • We do not knowingly collect Personal Information from children. 
  • We may in the future include other optional requests for information from the User including through user surveys to help us customize the Website to deliver personalized information to the User and for other purposes mentioned herein. Such information may also be collected in the course of contests conducted by us. Any such additional Personal Information will also be processed by this Privacy Policy. 

Purposes For Which the Company May Use the Information 

We will retain User Information only to the extent it is necessary to provide Services to the Users. The information, that we collect from you, may be utilized for various business and/or regulatory purposes including for the following purposes: 

  1. Registration of the User on the Website; 
  1. Processing the User’s orders/requests and provision of Services (including provision of safe Services); 
  1. Completing transactions with Users effectively and billing for the products/Services provided; 
  1. Technical administration and customization of Website; 
  1. Ensuring that the Website content is effectively presented to the Users; 
  1. Delivery of personalized information and target advertisements to the User; 
  1. Improvement of Services, features, and functionality of the Website; 
  1. Research and development and for User administration (including conducting user surveys); 
  1. Non-personally identifiable information, exclusively owned by the Company may be used in an aggregated or non-personally identifiable form for internal research, statistical analysis, and business intelligence purposes including those to determine the number of visitors and transactional details, and we may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates; 
  1. Dealing with requests, inquiries, complaints or disputes and other customer care-related activities including those arising out of the Users’ request of the Services and all other general administrative and business purposes; 
  1. Communicate any changes in our Services or this Privacy Policy or the Terms of Use to the Users; 
  1. Verification of identity of Users and perform checks to prevent fraud; and 
  1. Investigating, enforcing, resolving disputes, and applying our Terms of Use and Privacy Policy, either ourselves or through third-party service providers.  

 

Disclosure And Transfer of User’s Personal Information 

We may need to disclose/transfer the User’s Personal Information to the following third parties for the purposes mentioned in this Privacy Policy and the Terms of Use: 

Government institutions/authorities to the extent required: 

  1. Under the laws, rules, and regulations and/or under orders of any relevant judicial or quasi-judicial authority; 
  1. To protect and defend the rights or property of the Company; 
  1. To fight fraud and credit risk; 
  1. To enforce the Company’s Terms of Use (to which this Privacy Policy is also a part); or 
  1. When the Company, in its sole discretion, deems it necessary to protect its rights or the rights of others. 

If otherwise required by an order under any law for the time being in force including in response to inquiries by Government agencies for verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offenses. 

The Company makes all User Information accessible to its employees and data processors only on a need-to-know basis. All the employees and data processors, who have access to, and are associated with the processing of User Information, are obliged to respect its confidentiality. 

Non-personally identifiable information may be disclosed to third-party ad servers, ad agencies, technology vendors, and research firms to serve advertisements to the Users. The Company may also share its aggregate findings (not specific information) based on information relating to the User’s internet use to prospective, investors, strategic partners, sponsors, and others to help the growth of the Company’s business. 

We may also disclose or transfer the User Information, to another third party as part of the reorganization or a sale of the assets or business of the Company. Any third party to which the Company transfers or sells its assets will have the right to continue to use the Personal Information and/or other information that a User provides to us. 

Links to Third-Party 

The links to third-party advertisements, third-party websites, or any third-party electronic communication services (referred to as “Third Party Links”) may be provided on the Website which is operated by third parties and is not controlled by, or affiliated to, or associated with the Company unless expressly specified on the Website. 

If you access any such Third-Party Links, we request you review the website’s privacy policy. We are not responsible for the policies or practices of Third-Party Links.  

 

 

Information Sharing 

We share sensitive personal information with any third party without obtaining the prior consent of the user in the following limited circumstances: 

(a) When it is requested or required by law or by any court or governmental agency or authority to disclose, for verification of identity, or the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offenses. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these Terms; and for complying with the applicable laws and regulations.  

(b) We propose to share such information within its group companies and officers and employees of such group companies to process personal information on its behalf. We also ensure that these recipients of such information agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. 

Security Practices and Procedures 

The Company adopts reasonable security practices and procedures to include, technical, operational, managerial, and physical security control measures to protect the Personal Information in its possession from loss, misuse, unauthorized access, disclosure, alteration, and destruction. 

The Company takes adequate steps to ensure that third parties to whom the Users’ Sensitive Personal Data or Information may be transferred adopt reasonable level of security practices and procedures to ensure the security of Personal Information. 

You hereby acknowledge that the Company is not responsible for any intercepted information sent via the Internet, and you hereby release us from any claims arising out of or related to the use of intercepted information in any unauthorized manner. 

Information Security 

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These include internal reviews of our data collection, storage, and processing practices, and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. 

All information gathered on our website is securely stored within our controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet. And, of course, any information you include in a posting to the discussion areas is available to anyone with Internet access.  

However, the internet is an ever-evolving medium. We may change our Privacy Policy from time to time to incorporate necessary future changes. Of course, our use of any information we gather will always be consistent with the policy under which the information was collected, regardless of what the new policy may be. 

 

 

 

User’s Rights about Their Personal Information Collected by The Company 

All the information provided to the Company by a User, including Sensitive Personal Data or Information, is voluntary. The user has the right to withdraw his/her/its consent at any time, by the terms of this Privacy Policy and the Terms of Use, but please note that withdrawal of consent will not be retroactive. 

Users can access, modify, correct, and delete the Personal Information provided by them which has been voluntarily given by the User and collected by the Company by this Privacy Policy and Terms of Use. However, if the User updates his/her information, the Company may keep a copy of the information that the User originally provided to the Company in its archives for the User documented herein. In case the User seeks to update or correct, his/her Personal Information, the User may exercise these rights by emailing the Company at contact@dotpe.in and communicating the change(s) for updating the Company’s records. 

In case the User does not provide his/her information or consent for usage of Personal Information or subsequently withdraws his/her consent for usage of the Personal Information so collected, the Company reserves the right to discontinue the services for which the said information was sought. 

Age of Consent 

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

Changes to This Privacy Policy 

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. 

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you. 

Complaints and Grievance Redressal 

We take your privacy concerns seriously. If you have a complaint regarding our handling of your personal information or concerning our privacy practices, you may file a complaint with us using the contact details set out at the bottom of this Privacy Policy. We will confirm receipt of your complaint and, if we believe necessary, we will open an investigation into your complaint. 

We may need to contact you to request further details of your complaint. If an investigation has been opened following a complaint made by you, then we will contact you with the result of that complaint as soon as possible. In the unlikely circumstances, we are unable to resolve your complaint to your satisfaction, you may contact the local privacy and data protection authorities in your jurisdiction.

If users choose to connect their YouTube account with our API client, the following privacy terms apply: 

YouTube API Services: We use YouTube API services to provide features and functionality. By connecting your YouTube account, you agree to YouTube’s Terms of Service. 

Google Privacy Policy: The connection to YouTube is subject to Google’s Privacy Policy. You can review Google’s Privacy Policy at Google Privacy Policy. 

Revoking API Client’s Access: You can revoke our API Client’s access to your YouTube data at any time through your Google Security Settings. Please refer to the Google Security Settings Page for more information. 

Any complaints, abuse, or concerns with regards to content and or comment or breach of these terms shall be immediately informed to the designated Grievance Officer as mentioned below in writing or through email signed with the electronic signature to Warren Menezes (“Grievance Officer”).
